What counts as overtime in Morocco?
Overtime is an hour worked beyond normal working time: 44 hours a week or 2,288 hours a year in non-agricultural activities (article 184). It entitles the employee to a pay premium (article 201).
Many companies also count it beyond the scheduled day: an employee scheduled from 9 am to 5 pm who leaves at 7 pm has worked 2 hours of overtime. TEMPO offers both methods.

How is overtime paid on a Sunday or a public holiday?
On Sunday, overtime is paid at +50% by day and +100% by night if Sunday is the employee’s weekly rest day. Article 201 refers to the rest day, not to Sunday as such: if the rest day is Monday, Monday is the day that earns the higher rates.
For public holidays, TEMPO applies the same rates as the rest day by default, and you can change this setting to match your collective agreement.
How do you calculate overtime in Morocco?
- 1
Count the hours worked
Start from the punches and remove unpaid breaks.
- 2
Subtract normal working time
Subtract the scheduled day, or the 44 hours of the week, depending on your method.
- 3
Classify each hour
Working day or rest day, by day (6 am – 9 pm) or by night (9 pm – 6 am): each hour takes the rate of its box.
- 4
Apply the hourly rate
Pay 125%, 150% or 200% of the hourly rate calculated on the article 202 base.
- 5
Carry it into payroll
Overtime goes into gross pay, the CNSS base and taxable income.
Example: how much for a week with overtime?
An employee paid 25 DH an hour is scheduled for 44 hours from Monday to Saturday, with Sunday as the rest day.
- Tuesday, he leaves at 7 pm: 2 daytime hours at 125%, i.e. 62.50 DH.
- Thursday, he stays until 10 pm: 4 daytime hours at 125% (125 DH) and 1 night hour at 150% (37.50 DH), i.e. 162.50 DH.
- Sunday, he works from 10 am to 2 pm: 4 hours at 150%, i.e. 150 DH.
His 11 hours of overtime are paid 375 DH. At the hourly minimum wage in force since 1 January 2026 (17.92 DH, decree no. 2.25.983), an overtime hour is worth 22.40 DH at 25%, 26.88 DH at 50% and 35.84 DH at 100%.
Scheduled day or 44 hours a week: which threshold?
The threshold sets when an hour becomes overtime. TEMPO offers three settings:
- Beyond the scheduled day (default): whatever exceeds the day’s schedule is overtime.
- Beyond 44 hours a week: six 8-hour days give 4 hours of overtime, taken on Saturday.
- No threshold: for managers on a fixed-days agreement.
How does TEMPO calculate overtime?
The calculation starts from punches on your time clocks or phones.
Day, night, rest day, holiday
Each minute beyond the threshold takes the article 201 rate for its time and type of day.
Night shifts
A 10 pm to 6 am shift is split between night and day to the minute.
Your company’s own rules
Add your own bands by day and time slot, for example 75% after 7 pm.
Pay or time off in lieu
Pay the hours at premium rates or convert them into time off in lieu.
Into payroll
The activity statement totals hours at 25, 50 and 100% per employee and per period.

Questions fréquentes
What is the overtime rate in Morocco?
Article 201 of the Labour Code sets a 25% premium for hours worked by day (6 am – 9 pm) on a working day, and 50% by night (9 pm – 6 am). On the weekly rest day, the premium is 50% by day and 100% by night. These are minimums: a collective agreement or contract can provide more.
How do you calculate overtime in Morocco?
Count the hours worked beyond normal working time (the scheduled day or 44 hours a week), classify each by day (working or rest) and time (day or night), then multiply by the premium hourly rate: 125%, 150% or 200%. Example: 2 daytime hours at 25 DH an hour are worth 62.50 DH.
Is Sunday overtime paid double in Morocco?
Only at night. If Sunday is the employee’s weekly rest day, daytime hours are paid at +50% and night hours (9 pm – 6 am) at +100%, i.e. double the hourly rate. If the employee’s rest day falls on another day, Sunday is a working day and follows the 25% and 50% rates.
What is the overtime rate on a public holiday in Morocco?
Article 201 refers to the weekly rest day. By default, TEMPO applies the same rates to public holidays worked: 50% by day, 100% by night, with every hour of the day counted as overtime. You can change this setting in the time policy if your collective agreement provides otherwise.
What base is the overtime premium calculated on?
On the salary and its extras, excluding family allowances, tips and expense reimbursements (article 202). For a monthly-paid employee, one possible method converts the monthly salary into an hourly rate by dividing it by 191 hours, the month of article 238. Apply your payroll’s method consistently.
